This Territory Helper Terms of Service (this "Agreement") is entered into by Territory Helper and the entity executing this Agreement ("You"). This Agreement governs your use of Territory Helper.

Do not interfere with the services Territory Helper provides or try to access them using a method other than the interface and the instructions provided by Territory Helper. Territory Helper may suspend or stop providing services to you if you do not comply with the terms or policies if misconduct is suspected.

Using Territory Helper does not give you ownership of any intellectual property rights or the content you access.

The materials on Territory Helper's website are provided "as is". Territory Helper makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Territory Helper does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

Territory Helper is not held responsible for the content entered by you or its users. Content that is determined to be damaging or harmful to Territory Helper in any way can be removed without notifying you.

Territory Helper has not reviewed all the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Territory Helper of the site. Use of any such linked website is at the user's own risk.

Sub-Processors

Territory Helper may engage new sub-processors (level 2 processor) following advance notification of 5 days.

Data Processing and GDPR Compliance

When providing the Service, the Congregation acts as the Data Controller and Territory Helper acts as the Data Processor with respect to personal data processed through the Service.

Instructions
Territory Helper shall process personal data only on documented instructions from the Controller, unless required to do so by Union or Member State law. In such a case, Territory Helper will inform the Controller of that legal requirement before processing, unless the law prohibits such notice.

Confidentiality
Territory Helper ensures that all persons authorized to process personal data are subject to an appropriate duty of confidentiality.

Security
Territory Helper implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk, in accordance with Article 32 GDPR. These measures include encryption, pseudonymization, restricted access controls, secure backups, and regular monitoring.

Sub-Processors
Territory Helper shall ensure that all sub-processors are bound by data protection obligations no less protective than those set out in this Agreement, and remains fully liable for their performance.

Assistance with Data Subject Rights
Taking into account the nature of the processing, Territory Helper shall assist the Controller by appropriate technical and organizational measures, insofar as possible, in fulfilling obligations to respond to data subject requests under GDPR Chapter III (including rights of access, rectification, erasure, restriction, portability, and objection).

Assistance with Compliance
Territory Helper shall assist the Controller in ensuring compliance with Articles 32–36 of the GDPR, including obligations relating to personal data breaches, data protection impact assessments, and consultation with supervisory authorities.

Return or Deletion of Data
Upon termination of the Service, and at the choice of the Controller, Territory Helper shall delete or return all personal data, unless Union or Member State law requires continued storage.

Audit and Compliance
Territory Helper shall make available to the Controller all information reasonably necessary to demonstrate compliance with these data protection obligations, and allow for audits or inspections conducted by the Controller or an auditor mandated by the Controller, subject to confidentiality and reasonable notice.

Site Terms of Use Modifications

Territory Helper may revise these terms of use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
